Federal Judge issues permanent injunction in Archdiocese challenge to Obama Mandate

My apologies for being tardy in reporting on the decision of U.S. District Judge Brian Cogan to issue a permanent injunction in response to a lawsuit challenging the Obama mandate requiring employers to provide health coverage for drugs and procedures to which they have moral or religious objections.

Judge Cogan barred the Obama administration from enforcing the mandate against four not-for-profit affiliates of the Catholic Archdiocese of New York: Catholic Health Care System, Catholic Health Services of Long Island, Cardinal Spellman High School and Monsignor Farrell High School. They collectively challenged the mandate as an infringement of religious freedom.

The decision did not come as a surprise. As NRL News Today reported a year ago, Judge Cogan not only allowed the suit to go forward but had harsh words to say about the Obama administration.

in his recent 41-page decision, Judge Cogan wrote, the groups “have demonstrated that the mandate, despite the accommodation, compels them to perform acts that are contrary to their religion.” He added, “And there can be no doubt that the coercive pressure here is substantial.”

“The court has correctly cut through the artificial construct which essentially made faith-based organizations other than churches and other houses of worship second-class citizens with second-class First Amendment protections,” Joseph Zwilling, a spokesman for the Archdiocese of New York, said in a statement. “Religious freedom is our ‘First Freedom,’ guaranteed in the Constitution of the United States. This decision wisely and properly affirms that this freedom must extend beyond merely being free to choose how we worship, and must include how we act in accord with our religious beliefs.”

His explanation of what was/is at stake is worth quoting at greater length. He wrote

“At issue were the final mandate rules promulgated by HHS, which effectively split religious organizations into two classes: those who were protected under a narrow religious exemption – primarily dioceses and houses of worship – and those faith-based health care entities, charitable agencies, religious schools, and other faith-based entities which did not fit into this narrow definition established by the government.

With respect to this second category, HHS’s final rules “required these non exempt religious organizations to violate their consciences and cooperate,” Zwilling wrote “by ‘self certifying’ their religious objections thereby triggering their third party plan administrators to provide” the coverage to which they object. “In ruling that this self certification and so-called ‘accommodation’ procedure violates federal law, the decision makes clear that these non exempt entities would suffer ‘injury’ because ‘the Mandate renders them complicit in a scheme aimed at providing coverage to which they have a religious objection.’”

A well-loved and well-respected high school teacher was fired last night because he questioned a team of Planned Parenthood workers who bombarded his classroom earlier this semester, unannounced, to attempt to enroll Diss’ students in the Health and Human Services’ Teen Outreach Program (TOP).

Diss had not been informed whether or not the team, which turned out to be Planned Parenthood workers, had background checks or the proper sex abuse/child abuse certifications required to enter his classroom and interact with his students. Rather than supporting the conscientious objection of Diss as one of her teachers, the principal not only told Planned Parenthood to continue what they were doing, but also told Diss that he would not be excused from the classroom when he requested permission to leave due to his opposition to the event. The principal essentially told Diss that his moral beliefs did not matter.

 

Because Diss opposed Planned Parenthood in his classroom, and tried to look out for the welfare of his own students, Planned Parenthood and pro-abortion officials at the school –including the principal– banded together and sought to fire the teacher. The case for dismissal was heard by the school board on November 14, and last night it was announced that the official in charge of reaching a verdict on Diss’ case had determined that the teacher should be fired. To recap: A teacher lost his job today because he listened to his own conscience and acted in what he believed to be the best interest of his students when Planned Parenthood bombarded his classroom.

The decision to terminate Bill is clearly an example of bias against the teacher’s pro-life views, as evidenced by the fact that the decision does not align with existing Portland school laws and a huge outpouring of support from Diss’ students and their parents. Many students and parents have testified that Diss is an excellent teacher, mentor, and example to his students, writing letters of support and showing up at his pre-termination hearing last month.

Evidence was shown that Diss’ behavior, in line with his conscience, did not violate any Portland school law. Nevertheless, as we have seen time and again with Planned Parenthood in the past: the organization takes to bullying when it wants something. This time what it wanted was the career and livelihood of a pro-life teacher, and unsurprisingly that is what it got.

I credit President Bush’s embryonic stem cell policy for the amazing advances we are seeing with induced pluripotent stem cells, e.g., stem cells made from skin.

Not directly. But indirectly. Bush’s policy kept the entire world focused on the moral value of the embryo, and as a partial consequence, had scientists scurrying to find ways that would obtain the hoped-for benefits of ESCR [embryonic stem cell research] but without destroying human life.

Indeed, without Bush’s policy, I think scientists would have been chasing ESCR and human cloning down what have turned out to be (so far) box canyons, perhaps to the detriment of the kinds of advances we are seeing now, 12+ years after the Bush policy was announced.

Agree or disagree with my opinion, there is no denying the hope we now have thanks to ethical stem cell research: IPSCs have been used to fashion human kidneys in the lab. From the Telegraph story:

“Scientists in Australia have grown the world’s first kidney from stem cells – a tiny organ which could eventually help to reduce the wait for transplants. The breakthrough, published in the journal Nature Cell Biology, followed years of research and involved the transformation of human skin cells into an organoid – a functioning “mini-kidney” with a width of only a few millimetres.

“Scientists are hoping to increase the size of future kidneys and believe the resulting organs will boost research and allow cheaper, faster testing of drugs. Within the next three to five years, the artificial organs could be used to allow doctors to repair damaged kidneys within the body, rather than letting diseases develop before proceeding with a transplant.

“’This is the first time anybody has managed to direct stem cells into the functional units of a kidney,’ Professor Brandon Wainwright, from the University of Queensland, told The Telegraph.”

A new television commercial Coca Cola has produced for its new Coke Life product is drawing rave reviews from pro-life people because it celebrates the gift of life and the joys of parenthood.

The ad shows a young couple with a positive pregnancy test and tracks them through the growth of their baby into toddler hood and the ups and downs and crazy fun of having a baby. The ad concludes with a second positive pregnancy test and the father, drinking a Coke, initially looking outraged and quickly his surprise turns into sheer joy.

The Imperative of Christmas

Christmas is about God teaching us what love means. As Scripture tells us,

“This is how God showed his love among us: He sent his one and only Son  into the world that we might live through him.  This is love: not that we loved God, but that he loved us and sent his Son as an atoning sacrifice for  our sins” (1 John 4:9-10).

God took on a body at Christmas, and became visible, so that love could become visible. By having his own blood, he could shed it for us. By having his own body, he could offer it on the cross for us. And he shows this visibly so that we can imitate it. Hence Saint John writes,

“This is how we know what love is: Jesus Christ laid down his life for us. And we ought to lay down our lives for our brothers” (1 John 3:16).

That includes our brothers and sisters still in the womb, the children who are deprived of legal protection of their very lives (and therefore of all their other rights as well).

We are to lay down our lives for them! This is no abstract, make-believe, or half-hearted commitment. This is discipleship, which admits of no cheap grace. A passionate adherence to Christ — who took on a body at Christmas and has it to this day — means a passionate imperative to rescue the needy and to save them, not just spiritually but physically.

Basil of Caesarea, for instance, fought intensely against abortion and infanticide in the 4th century Roman Empire.

“So passionate was Basil in his concern for life that apparently, late one evening after Vespers, he and several deacons from the church actually went outside the city to dismantle the old Caesarean infanticide shrine with their bare hands. He knew that such direct action could very well have jeopardized his standing, but he was driven by an irrepressible spiritual imperative…

“Hearing of Basil’s solitary crusade, the Emperor Valentinian took the first step toward the full criminalization of child-killing in 374…’” {Third Time Around: A history of the Pro-life Movement from the First Century to the Present, by George Grant, 1991, Wolgemuth & Hyatt, Publishers, pp.20-21)

Notice the reference to being “passionate,” and to the “irrepressible spiritual imperative.” It is that expressed above by Saint John. Because Christ came among us physically and gave his life on the cross, we can give our lives for one another. We can take risks to protect one another. Basil was stirred by a physical evil, inspired by a God who became physical in the Incarnation,  and impelled to physical action.

God becoming visible at Christmas is not only a blessing we receive; it is an obligation we accept. In receiving the one who took on a body precisely to sacrifice it for us, we accept the duty and privilege of sacrificing our own bodies, possessions, and lives in order to love one another, especially the oppressed, first among whom are the unborn.

Lo Fundamental de la Navidad

La Navidad se trata de Dios enseñándonos lo que el amor significa. Como nos dice la Escritura:

“Miren como se manifestó el amor de Dios entre nosotros: Dios envió a su Hijo único a este mundo para que tengamos vida por medio de Él. En esto está el amor: no es que nosotros hayamos amado a Dios, sino que Él nos amó primero y envió a su Hijo como víctima por nuestros pecados.” (1 Juan 4: 9-10)

Dios se hizo de un cuerpo en Navidad, y se volvió visible, de tal manera que el amor se volviera también visible. Al tener ahora sangre propia, puede derramarla por nosotros. Al tener cuerpo propio, puede ofrecerlo en la cruz por nosotros. Y Él hace esto a la vista de todos para que podamos imitarle. De ahí que San Juan diga:

“Y en esto hemos conocido el amor; ahora también nosotros debemos dar la vida por los hermanos.” (1 Juan 3:16)

Eso incluye a nuestros hermanos y hermanas que están aún en el vientre, los niños que son privados de la protección legal de sus vidas (y por lo tanto, al mismo tiempo, de sus derechos).

¡Estamos dispuestos a dar nuestras vidas por ellos! Esto no es abstracto, ficción, o un compromiso tibio. Esto es discipulado, que no admite gracia barata. Una adhesión apasionada a Cristo – quien se hizo carne en Navidad y aún lo tiene hasta nuestros días – significa una apasionada obligación a rescatar a los que necesitan ser salvados, no sólo espiritualmente sino físicamente.

Porque Cristo vino al mundo físicamente y dio su vida en la cruz, nosotros podemos darla por otro. Podemos correr riesgos al protegernos unos a otros. As the president of Secular Pro-Life, I have been asked to present the non-religious case against abortion.  But actually, you’ve probably heard it already.  Many people who hear the secular arguments against abortion simply fail to recognize them as secular, because they expect pro-life apologetics to have a religious source.  Expectations powerfully color the way we see reality.  Discard these expectations, however, and you will soon find that most arguments against abortion do not require the existence of a god.

Call Me An ExtremistWe start from a premise that is shared by many religions and by secular humanism: the lives of human individuals are exceedingly valuable.  A religious person might express this concept as the “sanctity” of life, while a secular person might refer to the possession of fundamental human rights.  The core value judgment is the same.

We also make a factual assertion that human individuals begin their lives inside the womb, when sperm meets egg.  I began my life as a single-celled zygote; so did you.  The scientific consensus on this point is overwhelming.  Frankly, denying that life begins at conception is on par with denying the theory of natural selection; the evidence is that strong.  And what’s more, the leaders of the abortion rights movement know it.  While some rank-and-file abortion advocates will insist that the unborn aren’t alive, or are mere “blobs of tissue,” you will not hear such ignorance from the heads of abortion advocacy groups.  Nor will you hear it from abortion doctorsIntellectually honest people on both sides agree that abortion kills a living human individual.

The question raised by abortion is whether the living unborn human being is part of the human community, deserving of rights like older humans; or whether living unborn human beings should be treated differently, as objects rather than as persons.

Abortion supporters have suggested various justifications for the latter approach.  None are convincing.  In every case, a consistent application of the justification would allow the killing of some human beings outside the womb.

Consciousness

The most common justification for abortion is that unborn children are unconscious, at least in the early stages of pregnancy when most abortions are done.  Of course, you are unconscious every night when you go to sleep.  People who use this argument do not actually believe that the right to life depends on consciousness.  Probe more carefully, and they will clarify that they feel the right to life depends on an inherent capacity for consciousness.  But don’t unborn children have that capacity?  Consider a woman in a coma, who is expected to come out of the coma in a few months.  Is the unborn child’s situation appreciably different?  In both cases, consciousness is not present in the moment—there is only a potential for consciousness.  If that is a good enough justification for killing a child in the womb, and we’re going to be consistent, then the comatose woman is also a non-person who can be killed “on demand and without apology.”  That can’t be right.

Bodily autonomy

Another common abortion argument is the appeal to bodily autonomy; we’ve all heard the saying “my body, my choice.”  This is sometimes articulated as a belief that in order to have rights, you must not be dependent upon another body for survival.  But as with the consciousness argument, a consistent application of this rule would threaten rights of some born persons.

Other times, the bodily autonomy argument is expressed in terms of consent; you cannot use another person’s body without their permission, and if a woman does not want to be pregnant, the fetus does not have that permission.  If the only way to stop the fetus’ use of its mother’s body is to kill it, so be it.

That argument misses an important point: except in rape situations, the mother had a role in causing the unborn baby’s dependence in the first place.  In that light, it seems unfair to revoke consent—especially when doing so will kill someone!

When pro-lifers make this point, we are usually accused of being anti-sex and using pregnancy as a “punishment.”  That’s untrue.  It’s like saying that if you oppose drunk driving, you’re anti-beer!  Have your fun—just don’t put the lives of others at risk.

Women’s Health

Next, we have the argument that abortion is necessary to promote women’s health.  If abortion is not available on request, they say, women would rather risk harm themselves than allow their child to live.  In support of this theory, they point to the “bad old days of back-alley abortion,” when tens of thousands of women died annually.  This argument is powerful because it appeals to the same value that the pro-life movement does: a desire to save human lives.  The problem is that the women’s health argument has no basis in fact.

In the late 1960s, Dr. Bernard Nathanson co-founded the National Association for Repeal of Abortion Law, which now goes by the name NARAL Pro-Choice America.  Nathanson was an abortionist.  An atheist, he became pro-life when improved ultrasound technology convinced him of the humanity of the unborn child.  (He converted to Catholicism in his old age, and died in 2011.)  During his years as a pro-life atheist, he shared his insights into the early abortion movement—in particular, the messaging it used to shape the abortion debate.  One key tactic was to conjure abortion statistics out of thin air.  In Aborting America, Nathanson wrote:

It was always “5,000 to 10,000 deaths a year.” I confess that I knew the figures were totally false, and I suppose the others did too if they stopped to think of it. But in the “morality” of our revolution, it was a useful figure, widely accepted, so why go out of our way to correct it with honest statistics?

So what are the actual numbers?  According to the National Center for Health Statistics, 39 women died from illegal abortions in 1972, the year before Roe v. Wade.  Maternal deaths from abortion haven’t been in the thousands since the 1930s, before the advent of antibiotics!  For perspective, the CDC reports that 12 women died in legal abortions in 2009; that number is almost certainly low, because many states (notably California) do not report to the CDC.

It is scientifically undisputed that a new human organism begins at fertilization (or conception).  But that hasn’t stopped the American College of Obstetricians & Gynecologists (ACOG)—a proudly pro-abortion “medical” organization—from attempting to mislead courts into believing that life-ending drugs do not actually end the lives of tiny human beings.

ACOG’s efforts come in the many HHS mandate cases that are currently pending before federal courts all over the country, including the U.S. Supreme Court in Hobby Lobby Stores v. Sebelius andConestoga Wood Specialties Corp. v. SebeliusIn these cases, the plaintiffs are challenging the mandate in the Affordable Care Act (or “Obamacare”) that requires employers to fully cover, without co-pay, all drugs and devices labeled by the Food and Drug Administration (FDA) as “contraception.”

But here’s the problem: the FDA has labeled some drugs as “contraception” that actually work after a new human organism has been created.

Among many other facts from scientific journals, AUL has consistently cited the following in amicus briefs filed in federal courts in these cases:

  • “The fusion of sperm and egg membranes initiates the life of a sexually reproducing organism.”1
  • “Fertilization is the process by which male and female haploid gametes (sperm and egg) unite to produce a genetically distinct individual.”2
  • “Fertilization—the fusion of gametes to produce a new organism—is the culmination of a multitude of intricately regulated cellular processes.”3

Even the National Institutes of Health defines “fertilization” as the process of union of two gametes (i.e., ovum and sperm) “whereby the somatic chromosome number is restored and the development of a new individual is initiated.”

The same day that he was chosen as TIME magazine’s Person of the Year – Pope Francis exhorted North and South America to “accept human life at every stage, from the mother’s womb to old age.”

Amid misinterpretations of the pontiff’s pro-life stance in the mainstream media, the Holy Father continues to affirm his unwavering belief, completely united to that of the Catholic Church, that human life is sacred from conception to natural death.

He said (emphasis added):

Tomorrow is the feast of Our Lady of Guadalupe, the Patroness of the Americas. I would like to greet all my brothers and sisters on that continent, and I do so thinking of the Virgin of Tepeyac.

When Our Lady appeared to Saint Juan Diego, her face was that of a woman of mixed blood, a mestiza, and her garments bore many symbols of the native culture. Like Jesus, Mary is close to all her sons and daughters; as a concerned mother, she accompanies them on their way through life. She shares all the joys and hopes, the sorrows and troubles of God’s People, which is made up of men and women of every race and nation.

Mary’s embrace showed what America – North and South – is called to be: a land where different peoples come together; a land prepared to accept human life at every stage, from the mother’s womb to old age; a land which welcomes immigrants, and the poor and the marginalized, in every age. A land of generosity.

That is the message of Our Lady of Guadalupe, and it is also my message, the message of the Church. I ask all the people of the Americas to open wide their arms, like the Virgin, with love and tenderness.
