Family seeks to move teenager to another facility after judge rules she is brain dead

The increasingly bitter battle between the parents of a teenager declared brain dead and the hospital where her routine tonsillectomy went terribly awry December 9 continued yesterday when the family members said they wanted to transfer Jahi McMath to a nursing home they say is willing to continue her care.

The family’s announcement at a press conference Thursday followed the Tuesday decision of Alameda Superior Court Judge Evelio Grillo. Based on the independent evaluation of Dr. Paul Fischer that Jahi met the criteria for brain death, Grillo ruled that the 13-year-old could be taken off life support.

On Thursday, Jahi’s uncle, Omari Sealey, told reporters, “Yesterday we spent Christmas together as a family — doing a lot of prayers and trying to have some fun, hoping for a miracle, and looks like we may have gotten our miracle. We found out that someone is willing to take Jahi away from Children’s Hospital to a facility nearby here in the Bay Area to treat her,” Thursday.”

He added, “So right now, we’re asking Children’s Hospital to work with us to make that possible,” he said, referring to Children’s Hospital & Research Center Oakland.

The family did not name the other facility.

Christopher Dolan, the family’s attorney, said that Jahi would need to have breathing and feeding tubes inserted before she could be moved.

“The most logical people are the ones in the hospital where she’s sitting who have the ability to do that,” he said, according to the Los Angeles Times. “If they refuse to do that, and insist upon moving towards this deadline of pulling the plug, then we’ll just continue to do what we’ve been doing.”

Two Texas Baptist Institutions win challenge to Obama Mandate

Rosenthal today ruled in favor of two Texas Baptist institutions–East Texas Baptist University and Houston Baptist University–which opposed the Obama mandate that compels employers to provide health coverage for drugs and procedures to which they have moral or religious objections.

In its 46-page opinion, the federal court judge specifically rejected the government’s argument that it evaluate the Universities’ beliefs: “The religious organization plaintiffs have shown a sincerely held religious belief that the court cannot second-guess,” Judge Rosenthal wrote.

Religious plaintiffs have now won injunctions in 9 out of 12 such cases involving non-profit entities challenging the mandate, according to the Becket Fund for Religious Liberties.

“The government doesn’t have the right to decide what religious beliefs are legitimate and which ones aren’t,” said Eric Rassbach, Deputy General Counsel at the Becket Fund for Religious Liberty, and lead attorney for East Texas Baptist and Houston Baptist Universities. “In its careful opinion, the Court recognized that the government was trying to move across that forbidden line, and said “No further!”

The decision comes two weeks after the Obama administration suffered another defeat. (See “Federal Judge issues permanent injunction in Archdiocese challenge to Obama Mandate”)

In that lawsuit U.S. District Judge Brian Cogan issued a permanent injunction barring the Obama administration from enforcing the mandate against four not-for-profit affiliates of the Catholic Archdiocese of New York: Catholic Health Care System, Catholic Health Services of Long Island, Cardinal Spellman High School and Monsignor Farrell High School. They collectively challenged the mandate as an infringement of religious freedom.

In his 41-page decision, Judge Cogan wrote that the groups “have demonstrated that the mandate, despite the accommodation, compels them to perform acts that are contrary to their religion.” He added, “And there can be no doubt that the coercive pressure here is substantial.”

I hope you had a very Merry Christmas and are continuing to enjoy this wonderful season!
As we get closer to the New Year, I’ve been reflecting on the highlights of 2013. One such triumph was the June vote on the Pain-Capable Unborn Child Protection Act. This bill, which protects unborn babies – capable of feeling excruciating pain more than halfway through pregnancy, passed in the House of Representatives. It was the first time that Congress voted to protect an entire class of unborn children.
Pro-Life Friend, the fight to protect these unborn babies continues in the Senate into 2014.
The Pain-Capable Unborn Child Protection Act (S.1670) was introduced by Sen. Lindsey Graham (R-SC) in November. It is critical that the Senate join the House in holding a vote on this historic legislation in 2014.
Even pro-abortion Senator Harry Reid – Majority Leader in the Senate – said he’d be “happy to take a look” at it. But in order to force a vote in the Senate, every Senator needs to hear from their constituents. They must understand that protecting unborn babies from the horror of late abortion is the top priority.
Once you’ve take action, don’t forget to forward this on to all of your pro-life friends and family so they, too, can tell their Senators to support this historic bill.

Dr. Bernard Nathanson, a key architect of the abortion industry, said publicly to gatherings of clergy, after he became pro-life, that he and his pro-abortion colleagues in the 1960′s and 70′s “would never have gotten away with what we did if you (the clergy) had been united, purposeful, and strong.”

The key reason Priests for Life got started was the conviction that today’s proponents of the culture of death will still not get away with what they are doing if we become more united, purposeful, and strong.

Cardinal O’Connor was instrumental in the genesis and growth of Priests for Life, having released Fr. Frank Pavone in 1993 to do this work full time. In a letter to Fr. Frank, the Cardinal wrote, “I know of no effort more noble, more timely or important than the recruitment of our clergy in the cause of life.” (March 21, 1996).

Mindful, then, of the teaching and example of Cardinal O’Connor and Dr. Nathanson in this regard, Priests for Life intends to redouble its efforts in 2014 to train the clergy. With the support of Cardinal O’Connor’s sister, Mary Ward, we are launching the Cardinal John O’Connor Institute for the Pro-life Training of the Clergy, which will include a re-packaging of many of the activities Priests for Life has done all along, together with some new initiatives.

These activities, which will span all denominations across the Body of Christ, will include the following:

Training seminars for seminarians, deacons, and priests, in which our team will travel to seminaries and dioceses, and present a flexible package of presentations ranging in length anywhere from a luncheon talk to a seminar of several days, and covering the themes of preaching, counseling, and pro-life strategies and activities that can be carried out and promoted in parishes, schools, and other Catholic institutions.

Training in pro-life spirituality, with retreats and days of recollection available for seminarians, deacons, and priests.

A new book on Preaching the Pro-life Message, containing, among other things, answers to the most common fears about addressing abortion, and homily hints based on the readings of every Sunday of the three-year liturgical cycle. These homily hints are also available for each of these Sundays in video format on You Tube, as well as in a smartphone application.

Special training days offered for clergy at our New York headquarters of Priests for Life, as well as at our Washington DC office, right behind the Supreme Court. Sessions in Washington will include special opportunities to interact with practicing Christians in Congress and to learn more about how to support pro-life legislation.

Specialized training in post-abortion healing, making use of our expert team who developed Rachel’s Vineyard Ministries, which operates under the umbrella of Priests for Life, and also making use of the insights of our Silent No More Awareness Campaign.

Specialized training in the healing of former abortion clinic workers and abortionists, based on the research and experience of the “Society of Centurions,” a worldwide organization of former abortionists, who have gone through healing based on the model developed by Canadian psychiatrist Dr. Philip Ney, foremost expert in the psychology of abortionists.

Specialized training in how to dialogue with advocates and practitioners of abortion, and show to them the face of Christ, inviting them to conversion based on a recognition that our belief in the sanctity of every human life includes theirs, too.

Patricia Hamlin is a face of abortion. No, she wasn’t a victim of abortion. Rather she was one of the babies who are aborted each and every day because they were conceived in rape.

Like so many other people, Hamlin could have become a statistic — another casualty in the war on unborn children. And her mother, Brooke Mayo, could have done something that most people support, including many pro-lifers, because they fail to see the humanity of the unborn baby in what is obviously a horrific sexual assault experience.

But, like so many mothers who rejected an abortion or were determined to give their baby a chance at life, Mayo decided not to have an abortion and made an adoption plan for Brooke. Now, 71 years later, they’re reunited.

When you were giving a baby up for adoption, they were supposed to just whisk her away. But a little before midnight, a kindly nurse bent the rules and brought her into the room for a few minutes.

Brooke named her Delphine.

“She was so beautiful to me,” Brooke said. “I held that little darling. But then I handed her back. I handed her back and I wasn’t going to think about her again.”

A judge has ruled that a hospital in Oakland, California can remove life support from Jahi McMath, 13, who has been declared brain-dead days after undergoing surgery to have her tonsils removed. Her family is already devastated enough but has had to fight the hospital, which wanted to take her off life support against their wishes.

Jahi’s family has huddled by her side at Children’s Hospital Oakland these last couple of weeks calling on the community for prayers and searching for answers on what went wrong during what was supposed to be a one-night stay for the family favorite.

The family has appealed the decision but pro-life attorney Wesley Smith says it is unlikely they will prevail.

“The judge gave the family, still fighting the determination, until Monday to appeal or adjust to the tragic reality,” he said. “I hope the family spends the remaining time loving Jahi and making preparations, as there is zero chance in my view that the court’s ruling will be overturned on appeal. If a miracle is to happen, it will have to be when the breathing assistance is removed. People who are brain dead have no ability to breathe on their own.”

“It’s also a shame the hospital has handled the tragedy so maladroitly. I was speaking about this to a former pediatric nurse who used to work in Children’s Hospital Oakland’s ICU. She said the facility has a real calling to serving the African-American community, and this has hurt trust. That’s why I was upset to hear a hospital spokesman say he was “gratified” that the court validated the hospital’s diagnosis,” Smith continued. “No, the proper and decent thing would have been to say that they were sorry the original diagnosis was affirmed. Good grief.”

A woman with the message “I AM GOD” painted on her body jumped up on the altar and screamed in the middle of a Mass on Christmas at Cologne Cathedral, the home of the Roman Catholic Archbishop of Cologne and one of the tallest cathedrals in the world.

In their own statement, FEMEN boasted“Josephine foiled Christmas mass in the main cathedral.” As if a woman throwing a momentary screaming fit and getting dragged out somehow expels Christmas from a church. (Video below)

Sextremist of FEMEN Germany Josephine foiled Christmas mass in the main cathedral Kölner Dom of Cologne. In the presence of thousands of audience activist climbed onto the altar of the cathedral , protesting against the Vatican propaganda about criminalization of abortion.

FEMEN requires the Vatican elders and their fanatical followers to stop producing medieval chimeras and edit their rotten dogma in accordance with the modern world and human rights. Maniacal desire to control fertility ability of women have in common religion with national socialism , nationalism and other antediluvian anti-humanist ideologies.

Europe , wake up , you have to be an idiot to take seriously these sermons parody inquisitors . Everything smells of rot should be buried immediately ! Long live woman ! Long live the science !

This is the first of a series of posts profiling pro-life attorneys who use their JDs to promote a culture of life in a variety of different ways.

amy pedagnoAmy is a 26 year old currently living in Virginia. She earned her BA in Government and Politics with minors in Philosophy, English, and International Studies, from St. John’s University. Straight from undergraduate, she received her JD from Ave Maria School of Law. Amy currently works at the Law of Life Project.

Amy’s parents had a strong influence in her pro-life convictions. When she went to St. John’s College, she became very active in the campus Students for Life group. She knew that she was going to be committed to continuing pro-life work after college, but did not always know that she would want to practice pro-life law. During her senior year, she applied to a few law schools, still unsure if law was something that she really wanted to pursue. But she went to Ave Maria Law School and quickly realized that she loved studying law. Originally she planned to practice child advocacy law, working specifically with foster children. However she began to volunteer as a guardian ad litem in Florida, where she was able to advocate on behalf of foster children prior to completing her law degree.

Around this time, Amy was accepted into the Blackstone Fellowship Program with Alliance Defending Freedom, where she was placed for a summer job at Americans United for Life. The next summer, she returned to Americans United for Life as a legal fellow. She realized that it was possible to pursue pro-life work as a career and that she really loved pro-life law.

Amy is currently in her second year of a two year fellowship at the Law of Life Project. She is able is write briefs and edit papers, something that she really enjoys. She is also loves all the people she meets working as a pro-life attorney, other young attorneys who are committed to pro-life work and more experienced attorneys who are responsible for so many of the wonderful pro-life successes we’ve had so far.  One of her favorite parts of her job is being able to actually work for a cause that she believes in, and learning about how important public policy truly is.

Amy’s advice to those in law school hoping to pursue pro-life law is to be sure to spend time praying or reflecting on the commitment. Although she receives much affirmation from her job, there are sacrifices in pursuing pro-life law. Beyond the obvious pay cut compared to working at a big law firm, one always has to be ready to defend his or her pro-life beliefs. When asked “what do you do?” on the airplane, or at a dinner party, the question is a bit more loaded than for those who work in other jobs. One must always be ready to engage in discussion about abortion.

Amy also notes that there are many different ways to be a pro-life lawyer. We need pro-life lawyers in all aspects of law. A pro-life estate lawyer might be the perfect person to deal with end-of-life issues. A pro-life attorney working for a hospital can help to ensure that there is a strong ethics committee in place. A pro-life defense attorney can ensure that a pregnant defendant gets adequate medical care in detention.  Not every attorney is called to practice pro-life constitutional law full-time like Amy does, but that does not preclude living out their values as pro-life attorneys.

A short Christmas message with a movie suggestion

We are supposed to write a personal Christmas message to our readers today. However, I think you have heard more than enough from me this past year and so I am instead encouraging you to read the several wonderful pieces submitted by our staff.

One thing I want to share, though, even though it isn’t really a Christmas item per se, is a wonderful, absolutely beautiful, 90-minute online video that I just recently came across.  I found the dramatized true story of world famous Pediatric Neurosurgeon, Dr. Benjamin Carson, to be really inspiring. It is perfect for a Christmas holidays family movie night.  There are a  lot of wonderful messages in this high quality production that will leave your mind and heart stirred.

I have put it on this page, but you can also order the DVD for viewing on a larger screen than on a computer. Amazingly, I first saw the video, unintentionally, on my tiny iPhone screen.  It happened as I was going through my Facebook news feed at bedtime and came across the movie that someone had posted.

It was rather ridiculous watching a movie on my phone, which I have never done before, but I was so captivated that I could not put it down.

Later, I watched the movie again with some of my family on my computer screen (the free online version isn’t high quality enough for television viewing, but is excellent on a computer.)

I cannot remember a movie in recent months that has inspired me so much and left me thinking about its messages for many days afterwards, as this one did. And the classical music (loved by Dr. Carson) in the background in several parts of the movie gives it another, higher dimension.

So, if you can find the time, please do watch this video. You will not regret it. This is the kind of movie that is greatly needed today to uplift people’s spirits.

By the way, I suspect you will be hearing a lot more about Dr. Carson in the months ahead from what I have been reading about him. Seems he might possibly have a chance of becoming the kind of black president that all Americans could agree is a truly great man with a heart of gold and a brilliant mind.
